Firearms Trafficking

Firearms Offences Canada

After murder and manslaughter, firearms trafficking is quickly becoming one of the most serious offences in the Canadian Criminal Code. This is because, unlike drug trafficking where the product is consumable, firearms can last for decades, if not centuries. The regulation of firearms has also become a highly politicized topic in recent years. Because of the serious and highly political nature of these charges, they are vigorously prosecuted by senior Crown counsel. As such, if you have been charged with weapons or firearms trafficking (Section 99 of the Criminal Code) or possession of weapons or firearms for the purpose trafficking (Section 100 of the Criminal Code), be sure to find an experienced Alberta firearms trafficking lawyer.

Firearms Investigations Canada

Firearms trafficking cases often involve complex investigations with significant surveillance, undercover operations, confidential informants, and search warrants or other judicial authorizations (such as tracking devices). You will want to make sure that your Edmonton Criminal Lawyer has experience dealing with each of these investigative techniques.

Notable Cases

R v M.P., 2019 MBPC (Unreported)

Stacey obtained bail for an individual to continue parole (which is almost unheard of) at a half-way house in Winnipeg, MB, despite being charged with inter- provincial firearms trafficking in Manitoba.

R v M.P., 2018 ABQB (Unreported)

After running a highly successful preliminary inquiry on inter-provincial firearms trafficking charges, the Crown dropped the charges (i.e., entered a Stay of Proceedings) in the Alberta Court of Queen’s Bench.

R v J.S., 2018 ABQB (Unreported)

In the very first case of a straw purchaser in Alberta, Stacey successfully negotiated an eight-year sentence for a firearms-trafficking case where 39 handguns and 1- semi-automatic firearms were sold on the black market, most of which were not recovered or turned up in other crime scenes. What made this plea exceptional was that her client had also trafficked heroin not once, but twice, to undercover officers while on release for firearms trafficking.
